निखिल वागळे यांना सोशल मीडिया पोस्टवरून कायदेशीर नोटिस;बिनशर्त माफी मागण्याची मागणी

जेष्ठ पत्रकार निखिल वागळे यांनी भारताच्या सरन्यायाधीशांविषयी केलेल्या दोन सोशल मीडिया पोस्टवरून अॅडव्होकेट अमिता सचदेवा यांनी कायदेशीर कारवाईचा इशारा दिला आहे. पहिल्या पोस्टसंदर्भात कायदेशीर नोटीस बजावण्यात आल्याचा दावा करत, आता दुसरी आक्षेपार्ह पोस्टही प्रकाशित केल्याचे त्यांनी म्हटले आहे.

११ ऑक्टोबर २०२६ रोजी जेष्ठ पत्रकार निखिल वागळे यांनी सरन्यायाधीशांना उद्देशून “Fuck you CJI!”

अशी पोस्ट एक्स या सोशल मीडियावर केल्याचा आरोप आहे.

या पोस्टबद्दल त्यांना यापूर्वीच कायदेशीर नोटीस बजावण्यात आल्याचे सचदेवा यांनी म्हटले आहे.

त्यानंतर वागळे यांनी “भारताच्या सरन्यायाधीशांचा आदर करण्याचे दिवस आता संपले आहेत,”

अशा आशयाची आणखी एक पोस्ट #CJI या हॅशटॅगसह केल्याचा दावा त्यांनी केला आहे.

दोन्ही पोस्ट एकत्रितपणे आणि त्यांच्या संदर्भासह पाहिल्यास, त्या न्यायव्यवस्थेची प्रतिष्ठा धुळीस मिळवण्याचा आणि न्यायदान प्रक्रियेवरील जनतेचा विश्वास कमी करण्याचा प्रयत्न असल्याचे दिसते, असे सचदेवा यांनी नोटिशीत नमूद केले आहे.

Mr. Nikhil Wagle (@waglenikhil), You appear to be a habitual offender who is persistently engaging in conduct calculated to undermine the dignity, authority, and public standing of the Hon’ble Chief Justice of India. Your earlier post stating “Fuck you CJI!” was already the subject of a legal notice duly served upon you. Despite being put on notice, you have now published another objectionable post asserting that “the days of showing respect to India’s Chief Justice are long gone,” accompanied by the hashtag #CJI. Your repeated conduct demonstrates a blatant disregard for the dignity of the highest judicial office in the country. Such statements, viewed cumulatively and in their proper context, are contemptuous and appear calculated to scandalise the institution of the judiciary and erode public confidence in the administration of justice. The freedom of speech and expression guaranteed under the Constitution of India does not confer an unrestricted licence to abuse, scandalise, or undermine the authority of the judiciary. You are hereby called upon to immediately delete both the aforesaid posts and tender an unconditional public apology within the remaining period stipulated in the legal notice already served upon you. Take further notice that, in the event of your failure to comply within the stipulated time, I shall be constrained to seek the requisite consent of the Ld. Attorney General for India, as required under law, and initiate appropriate criminal contempt proceedings before the Hon’ble Supreme Court of India, without any further notice to you, at your sole risk as to the consequences thereof. भारतीय संविधानाने दिलेले अभिव्यक्तिस्वातंत्र्य न्यायव्यवस्थेचा अपमान करण्यासाठी,

तिची बदनामी करण्यासाठी किंवा तिच्या अधिकाराला कमी लेखण्यासाठी अमर्याद परवानगी देत नाही, असेही त्यांनी म्हटले आहे.

वागळे यांनी दोन्ही पोस्ट तातडीने हटवाव्यात आणि यापूर्वी बजावलेल्या कायदेशीर नोटिशीत नमूद केलेल्या मुदतीत बिनशर्त सार्वजनिक माफी मागावी, अशी मागणी करण्यात आली आहे. निर्धारित मुदतीत पालन न झाल्यास भारताच्या अॅटर्नी जनरल यांची कायद्यानुसार आवश्यक संमती घेऊन सर्वोच्च न्यायालयात फौजदारी न्यायालय-अवमानाची कार्यवाही सुरू करण्यात येईल, असा इशाराही सचदेवा यांनी दिला आहे. पुढील कोणतीही नोटीस न देता कारवाई केली जाऊ शकते, असेही त्यांनी स्पष्ट केले आहे.
